End User License Agreement (EULA)

This End User License Agreement (“Agreement”) is a binding legal contract between you (“User” or “you”) and ChomChomTech (“Company,” “we,” “us,” or “our”). By downloading, installing, or using the ChomChomTech mobile application (the “App”), you agree to be bound by the terms of this Agreement.
If you do not agree to these terms, do not download, install, or use the App.

1. License Grant

ChomChomTech grants you a personal, revocable, non-exclusive, non-transferable, limited license to install and use the App on a single mobile device owned or controlled by you, strictly in accordance with the terms of this Agreement.

2. License Restrictions

You agree not to, and you will not permit others to:
* Decompile/Reverse Engineer: License, sell, rent, lease, assign, distribute, host, or otherwise commercially exploit the App.
* Modify: Modify, make derivative works of, disassemble, decrypt, reverse compile, or reverse engineer any part of the App.
* Circumvent: Remove, alter, or obscure any proprietary notice (including copyright or trademark notices) of ChomChomTech.

3. Intellectual Property

The App, including without limitation all copyrights, patents, trademarks, trade secrets, and other intellectual property rights, are and shall remain the sole and exclusive property of ChomChomTech. Use of the App does not grant you any ownership interest in the software.

4. Privacy and Data

Your privacy matters to us. Our collection and use of personal information through the App are governed by our Privacy Policy. By using the App, you consent to the data practices outlined therein.

5. Termination

ChomChomTech may, in its sole discretion, at any time and for any or no reason, suspend or terminate this Agreement with or without prior notice.
* Upon termination, you must cease all use of the App and delete all copies from your device.
* Sections regarding Intellectual Property, Indemnification, and Limitation of Liability shall survive termination.

6. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall ChomChomTech be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data, or business interruption) arising out of the use of or inability to use the App.

7. Disclaimer of Warranties

The App is provided to you “AS IS” and “AS AVAILABLE” and with all faults and defects without warranty of any kind. ChomChomTech provides no warranty that the App will meet your requirements, achieve any intended results, or be compatible with any other software or systems.

8. Governing Law

This Agreement shall be governed by the laws of the jurisdiction in which ChomChomTech is headquartered, excluding its conflicts of law rules.

  • “Kids App” means the ChomChom Kids mobile application used by children.
  • “Services” include:
    • Activity tracking
    • Mood and behavior insights
    • Habit tracking
    • AI-powered recommendations
    • Progress reports and analytics
  • “User” means parents, guardians, teachers, or counselors.
  • “Child” means a minor whose data is monitored through the App.
  • “User Content” includes:
    • Mood logs
    • Activity data
    • Behavioral patterns
    • Journal entries
  • “AI Features” means automated insights and recommendations generated by the App.
  • “Subscription” means paid recurring plans within the App.

2. ELIGIBILITY

You must be at least 13 years old to use the App. If under 18, you must have parental or guardian consent.

3. LICENSE GRANT

ChomChomTech grants you a personal, revocable, non-exclusive, non-transferable, limited license to install and use the App on a single mobile device owned or controlled by you, strictly in accordance with the terms of this Agreement.

5. SUBSCRIPTIONS & BILLING (AUTO-RENEWAL)

  • Some features require a paid Subscription
  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period
  • Payment will be charged to your Apple ID or Google Play account
  • Subscriptions can be managed or canceled in your account settings
  • No refunds are provided except where required by law

6. FREE TRIALS (IF APPLICABLE)

We offer a 7-day free trial for eligible subscriptions.

  • The free trial begins when you activate a subscription for the first time
  • You will not be charged during the 7-day trial period
  • After the trial ends, your subscription will automatically convert into a paid plan unless canceled at least 24 hours before the trial expires
  • Payment will be charged to your Apple ID or Google Play account upon the end of the trial period
  • You can manage or cancel your subscription at any time through your account settings

7. USER CONTENT

  • You retain ownership of your content
  • You grant us a worldwide, non-exclusive license to process and use your content to provide Services
  • You are responsible for ensuring your content complies with laws and does not violate third-party rights

8. DATA SECURITY & RETENTION

  • We use industry-standard security measures
  • No system is 100% secure
  • Data is retained only as necessary

9. DATA ACCURACY & LIMITATIONS

We do not guarantee:

  • Accuracy of insights
  • Completeness of reports
  • Real-world applicability

All outputs are for general guidance only.

 

10. MAINTENANCE AND SUPPORT

ChomChom Tech, Corp is solely responsible for maintenance and support. Apple and Google have no obligation to provide support.

11. INTELLECTUAL PROPERTY
